This Privacy Policy explains how KML Personal GmbH & Co. KG processes personal data in connection with the Drive Germany website and professional driver recruitment programme.

We take the protection of personal data seriously and process personal information in accordance with the General Data Protection Regulation (GDPR) and applicable German data protection law.

2. Website hosting and technical operation

The Drive Germany website is created and hosted using Framer.

When the website is accessed, technical information required to deliver, secure and operate the website may be processed.

This may include technical connection and device information such as IP address, browser information, operating system, access time and requested pages where technically required for website operation and security.

The processing is carried out for the purpose of providing a secure and functional website.

Where applicable, the legal basis is Art. 6(1)(f) GDPR. Our legitimate interest is the secure and reliable operation of the Drive Germany website.

FRAMER ANALYTICS

3. Website analytics

We may use the built-in analytics functions provided by Framer to understand general website usage.

According to Framer, its built-in analytics does not use cookies or persistent identifiers and does not store information that identifies individual website visitors.

We currently do not use Google Analytics as part of the Drive Germany website unless this Privacy Policy is updated accordingly.

DRIVE GERMANY APPLICATION

4. Processing of applicant data

When you apply to the Drive Germany programme, we process the information that you provide through the application form.

Depending on the information submitted, this can include:

  • name

  • date of birth

  • email address

  • telephone number

  • current city and province

  • professional truck-driving experience

  • vehicle types driven

  • current or previous employer information

  • professional references

  • driving licence information

  • PrDP / PDP information

  • CV

  • uploaded driving licence documents

  • uploaded PrDP / PDP documents

  • German-language ability

  • willingness to learn German

  • willingness to relocate to Germany

  • willingness to complete the required professional driver qualification

  • willingness to complete required medical and eyesight examinations

  • ability to obtain a Police Clearance Certificate

  • other information voluntarily provided in the application

At the initial application stage we do not request medical diagnoses or detailed medical records.

We also do not initially request the Police Clearance Certificate itself.

Additional documents may be requested later if an applicant progresses through the recruitment, immigration or qualification process.

PURPOSE OF PROCESSING

5. Why we process applicant information

Applicant information is processed for purposes including:

  • assessing whether an applicant meets the Drive Germany programme requirements

  • evaluating professional driving experience and qualifications

  • communicating with applicants

  • conducting interviews and candidate screening

  • matching suitable applicants with participating German employers

  • preparing possible employment

  • coordinating language training

  • preparing immigration and visa processes

  • coordinating driving licence conversion and professional driver qualification

  • supporting relocation and integration processes

  • administering the recruitment programme

Submitting an application does not guarantee employment, a visa, immigration approval or relocation to Germany.

LEGAL BASIS

6. Legal basis for processing

Depending on the individual processing activity, applicant data may be processed on the following legal bases:

Art. 6(1)(b) GDPR:

Processing that is necessary in order to take steps at the applicant’s request before entering into an employment or recruitment relationship.

Art. 6(1)(f) GDPR:

Processing based on our legitimate interests in operating an international recruitment programme, assessing applicants, managing recruitment processes and, where necessary, establishing, exercising or defending legal claims.

Where applicable, German employment-data rules, including § 26 BDSG, may also apply.

Art. 6(1)(a) GDPR:

Where an applicant has voluntarily provided specific consent, for example to receive information about future Drive Germany opportunities.

Consent may be withdrawn at any time with effect for the future.

APPLICATION FORM PROVIDER

7. Application form provider – Jotform

The Drive Germany application form is provided using Jotform.

Jotform processes application information on behalf of KML Personal in order to provide and operate the online application form.

This can include:

  • information entered into the application

  • uploaded documents

  • technical information required to provide and secure the form

KML Personal remains responsible for the purposes for which applicant information is collected and used.

Jotform may use approved subprocessors to provide its services.

Where personal data is processed outside the European Economic Area, appropriate safeguards are used where required by applicable data protection law, including recognised transfer mechanisms such as Standard Contractual Clauses or other lawful transfer mechanisms.

RECIPIENTS

8. Who may receive your information?

Within KML Personal, access to applicant information is limited to persons who require the information for recruitment and programme administration.

If an applicant progresses through the programme, relevant information may also be shared with:

  • prospective German employers

  • language and training providers

  • professional driver qualification providers

  • immigration and relocation service providers

  • authorities where required for immigration, residence, driving licence or qualification procedures

  • IT and technical service providers acting on our behalf

Information is only shared to the extent necessary for the respective recruitment or programme purpose.

We will not forward an applicant’s full application to a prospective employer without informing the applicant and, where legally required, obtaining the necessary consent.

FUTURE OPPORTUNITIES

9. Future job opportunities and talent pool

Applicants may voluntarily choose to receive information about future suitable Drive Germany opportunities.

This is optional and has no effect on the assessment of the current application.

Where this option is selected, the legal basis for the additional processing is Art. 6(1)(a) GDPR.

RETENTION

10. How long do we keep applicant data?

Applicant information is stored for as long as necessary to conduct the relevant recruitment and placement process.

If an application is unsuccessful and no further recruitment process is planned, applicant information will generally be deleted no later than six months after completion of the relevant application process, unless a longer period is required for the establishment, exercise or defence of legal claims or another legal obligation applies.

If an applicant has voluntarily agreed to receive future suitable opportunities, relevant applicant information may be retained in the Drive Germany candidate pool for up to 24 months.

Applicants may withdraw this consent at any time.

Where an applicant enters employment or a separate contractual relationship, different statutory or contractual retention periods may apply.

INTERNATIONAL DATA TRANSFERS

11. International data processing

Drive Germany recruits applicants internationally, including applicants located in South Africa.

Some technical service providers or their subprocessors may operate outside the European Economic Area.

Where KML Personal transfers personal data to recipients in countries without an EU adequacy decision, appropriate safeguards are used where required, such as Standard Contractual Clauses or another lawful transfer mechanism.

DATA SECURITY

12. Data security

KML Personal takes appropriate technical and organisational measures to protect personal information against unauthorised access, loss, misuse, alteration or disclosure.

Access to applicant information is restricted to authorised persons and service providers who require access for the respective recruitment or programme purpose.

No method of electronic transmission or storage can guarantee absolute security.

AUTOMATED DECISIONS

13. Automated decisions

Drive Germany does not currently make final employment or programme-selection decisions solely through automated decision-making.

Applications are reviewed by KML Personal and participating employers make their own final employment decisions.

If automated decision-making within the meaning of Art. 22 GDPR is introduced in the future, this Privacy Policy will be updated accordingly.

DATA SUBJECT RIGHTS

14. Your rights

Subject to the applicable legal requirements, you may have the following rights:

  • right of access to your personal data

  • right to correction of inaccurate information

  • right to deletion

  • right to restriction of processing

  • right to data portability

  • right to object to certain processing

  • right to withdraw consent at any time where processing is based on consent

Withdrawal of consent does not affect the lawfulness of processing carried out before the withdrawal.
